I have the same problem, done tons of critical beatdowns even managing to do 3 in the same combo chain a few times with no unlocking.

I've found a few other posts on the internet about this problem, so I'm pretty sure its a glitch that'll hopefully get patched out.

You dont even need to do the beatdown on them. All kinds of criminal geniuses can come in freely. This great and beautiful operation is a TD superhero.
